Below is the official resolution by 1 and 2 family homeowners across the city of New York! We need your support, so please add your signature to help us reach our goal of crafting a sensible amendment that keeps small homeowners from being pushed out of their neighborhoods by wealthy developers.
RESOLUTION
The following have been hereby resolved and agreed upon by the signatories hereto, who exclusively constitute of natural persons who own one to two family residential properties within the City of New York that are defined as a “private dwelling” under Section 27-2004 (6) of the New York City Administrative Code (hereinafter, Private Dwelling):
(1) Measures are to be taken by the signatories hereto to allow them more time to have their registrations, under Section 26-3102 of the New York City Administrative Code, for the use of their Private Dwellings as Short-Term Rentals, as defined under Section 26-3102 of the New York City Administrative Code, fully processed before the enforcement, pursuant to the authority of Section 26-3104 of the New York City Administrative Code and under the procedures outlined therein, of violations of the provisions of Sections 26-3102 and 26-3103 thereof. Such measures shall include formally requesting from the Office of the Mayor of the City of New York a further moratorium on the said enforcement as against said violations. Such measures are deemed necessary because New York City Mayor’s Office of Special Enforcement is currently overwhelmed by the influx of thousands of registration applications under Section 26-3102 of the New York City Administrative Code to the extent that only approximately three hundred (300) of said registration applications have been processed within the last four (4) months.
(2) Measures are to be taken by the signatories hereto, in coordination with the Office of the Mayor of the City of New York and New York City Council representatives, towards effecting amendments to the New York City Housing Maintenance Code, including Section 27-2004 of the New York City Administrative Code, among others, so as to effectively be able to exempt natural persons who own Private Dwellings, such as the signatories hereto, from the requirements under Sections 26-3101 to 26-3105 and 26-3201 to 26-3203 of the New York City Administrative Code while, at the same time, ensuring that the safety concerns that constituted the basis for the New York City Housing Maintenance Code are still effectively addressed thereby. Such measures shall include, among others, discussions with the Office of the Mayor of the City of New York and New York City Council representatives to determine the appropriate amendments and procedures to effect said amendments, and the drafting of proposed legislation. Moreover, considering the time the enforcement, pursuant to the authority of Section 26-3104 of the New York City Administrative Code and under the procedures outlined therein, of violations of the provisions of Sections 26-3102 and 26-3103 thereof shall take effect, and the time it will take to effect the aforesaid amendments to the New York City Housing Maintenance Code so as to, among other things, exempt natural persons who own Private Dwellings from the requirements under Sections 26-3101 to 26-3105 and 26-3201 to 26-3203 of the New York City Administrative Code, a formal request shall be made to the Office of the Mayor of the City of New York for a further moratorium on the said enforcement as against said violations.
(3) The signatories hereto support New York Home Alliance Corp., a signatory hereto, on behalf of the signatories hereto, to commence in taking the steps and measures described under paragraphs (1) and (2) hereto.
